Dear Neighbor,

This letter is being written on behalf of the Ivan Downs Homeowners Association.  In a continuing effort to maintain community enjoyment and high property values, the Board of Directors responsibility is to ensure the Association’s Rules & Regulations, Covenants, Conditions & Restrictions, and By-Laws are enforced.

We would like to take this time to reiterate some of these restrictions, as it is in the best interest of each of the property owners in the Ivan Downs community.  Some of these restrictions are being violated at this time and others have come into question.  Please make note of the following restrictions, and make adjustments on your property as needed to avoid further procedures for enforcement of violations.

•    No temporary buildings, sheds, tents, trailers, or signs of any kind shall be erected, constructed, permitted or maintained on any Lot at any time.
•    No house trailer, mobile home, travel trailer, trailer, tent, camper truck, boat or recreational vehicle of any type may be maintained, stored or kept upon any Lot or portion of the Subject Property unless the same shall be located in such a way as to be completely within an enclosure or screened area so that it is not visible from roads or adjoining Lots.  The Association, in its sole discretion, may prohibit the storage or parking of any boat, recreational vehicle or equipment on any Lot.  The parking of commercial trucks, rigs, or vans is prohibited on any Lot, except on a temporary basis during construction.
•    Solid waste and recycle waste receptacles must be kept from sight other than for scheduled collections.
•    Sufficient parking space shall be provided on each Lot for all vehicles to park OFF of the streets, alleys and off the lawn areas of other Owners and the Common Areas.
•    No swimming pool shall be installed or constructed without specific written approval from the Architectural Review Board (ARB).  Above ground pools will not be permitted.
•    No exterior antennas of any kind shall be allowed or maintained upon any portion of the Subject Property, including any Lot, or portion thereof, without the prior written consent of the ARB.  No free standing antennas whatsoever shall be placed on any Lot.  Satellite dishes, no larger than twenty-four inches in diameter, shall be permitted; provided it is properly screened to be concealed from view from neighboring properties and the street.
•    Any yard fence must be approved by the ARB in writing.  The fence shall be aesthetically pleasing and conform to the nature of the general area.  Chain link fence, barbed wire, or chicken wire fences are not acceptable.  No fences shall be constructed closer to the front property line than the rear corners of the home.
•    Ornamental yard furniture, hardware, statues, etc., are to be kept to a minimum in the front lawn areas and should be screened in the rear areas so as to not create an objectionable nuisance.
•    All mechanical equipment, utilities, solid waste receptacles, and service areas are to be screened from the public view.
•     No noxious or offensive activity shall be carried on, in, upon, or about any Subject Property nor shall anything be done thereon which may be or may become an annoyance or a nuisance to the Community.
•    No trade, business, or occupation of any kind shall be conducted on any Lot except that members of their recognized professions in the Community may receive the usual ordinary calls at their home.  Nothing shall be done on any Lot which may become an annoyance or nuisance to the Community.
•    Until construction commences, each Lot Owner shall keep his or her Lot maintained as a completed lawn of less than fifteen inches (15”) in height.

In addition, please note house number signs and mailboxes are required to be the same and can be purchased through Signature Signs.

Please refer to the complete copy of the Declaration of Protective Covenants and Restrictions for the Ivan Downs Planned Unit Development for additional information and restrictions.  A copy of these restrictions will be provided to you upon request.  You will find a copy of the Procedures for Enforcement of Violations enclosed with this letter.

The association is in the process of developing a website for the neighborhood. The website is currently under construction, however may be viewed at www.ivandowns.com.  The website will contain a copy of the Ivan Downs restrictions, as well as information on happenings in the Ivan Downs community.  Other suggestions for content of the website are welcomed.
